Privacy Policy

What we collect when you request funding, what we do with it, and the rights you have over it.

This Privacy Policy explains how FundingLane LLC, trading as FundingLane(“we,” “us,” or “our”), handles information collected through fundinglane.net. We are a California limited liability company with a principal office in San Diego, California 92101.

1. Information we collect

When you submit a loan request we collect the information you enter: your name, your email address, your phone number, your home address, your date of birth, information about your income and employment, information about the bank account you would want funds sent to, and the amount you are requesting. We also record the consent choices you make, the IP address the request came from, and the browser user agent, because a record of consent is a compliance requirement.

When you use the contact form we collect your name, email address, an optional company name and subject, and your message. When you use the unsubscribe pages we process the email address and the signed token contained in the link.

2. Information we do not collect

We do not ask for and do not store bank login credentials. Where a bank connection is used during verification, it is performed by a third-party connection provider. We do not knowingly collect information from anyone under 18; our service is available only to adults. If a lender you are connected with asks you for a Social Security number, a full bank account number or a copy of an identity document, that request is the lender’s and that information goes to the lender, not to us.

3. How we use information

We use the information to transmit your request to lenders and lending partners, to communicate with you about it, to meet legal and record-keeping obligations, to detect and prevent fraud and misuse, and to improve the site. We do not use it to make any decision about your creditworthiness, because we make no such decision. Where you have given separate optional consent, we also use your email address to send loan information as described in our Email Communications Terms.

4. How we share information

We share the information you submit with lenders and lending partners who may be able to make you a loan offer — that is the purpose of the service — and with service providers that operate our infrastructure, such as hosting, database and email delivery providers, acting on our instructions. We may disclose information where required by law, regulation, legal process or an enforceable governmental request, and in connection with a merger, financing or sale of assets, in which case we will require the recipient to honour this Policy.

Read this part rather than skimming it. We may be paid by a lender when a request we transmit results in a funded loan. Because that transfer is made for value, California law may treat it as a “sale” or “sharing” of your personal information, even though what is happening is simply that your request is being passed to lenders so they can respond to it. We say so plainly here instead of claiming that we never sell your information, and section 9 tells you how to opt out.

5. Retention

We retain funding request records for as long as needed for the purpose they were collected and to satisfy legal, tax and audit obligations, and then delete or anonymise them. Consent and suppression records are retained for as long as we operate the email programme, because they are the evidence that your choices were honoured.

6. Security

Traffic to and from this site is encrypted in transit. Access to submitted requests is limited to people who need it to do their job. We apply technical and organisational measures appropriate to the sensitivity of the data, and we review them. No method of transmission or storage is completely secure, and we do not claim otherwise.

7. Notice of a data breach

If we determine that unencrypted personal information has been, or is reasonably believed to have been, acquired by an unauthorised person, we will notify affected individuals without unreasonable delay in accordance with California law, including 6 Del. C. § 12B-102, and any other breach-notification law that applies to the affected residents. Where the law requires it, we will also notify the California Attorney General and provide credit monitoring where mandated.

8. Your rights

Depending on where you live, you may have the right to access the personal information we hold about you, to correct it, to request deletion, to receive a portable copy, to opt out of the sale or sharing of personal information, and not to be discriminated against for exercising any of these rights. Residents of the European Economic Area and the United Kingdom additionally have the rights of access, rectification, erasure, restriction, portability and objection under the General Data Protection Regulation. To exercise any right, email help@fundinglane.net. We will verify your identity before acting, and we respond within the period the applicable law allows.

9. California residents

FundingLane LLC is formed in California and this section applies to you if you live here. Under the California Consumer Privacy Act as amended by the California Privacy Rights Act you have the right to know what personal information we have collected about you and where it came from, to obtain a copy of it, to have it corrected, to have it deleted, to limit the use of sensitive personal information, and to opt out of the sale or sharing of your personal information. You also have the right not to be treated differently for exercising any of them.

What this means in practice. The whole purpose of this site is to pass your request to lenders, and we may be paid when that results in a funded loan, so opting out of sale and sharing means we can no longer connect you with a lender. That is not a penalty — it is the service itself, and you are free to make the request anyway. To opt out, or to exercise any other right, email help@fundinglane.net with “California privacy request” in the subject line, or write to us at the address in section 13. We will verify your identity before acting, and we will respond within 45 days, extendable once where the law allows. You may use an authorised agent, and we will ask for proof of their authority.

In the 12 months before the date below we collected the categories of information listed in section 1 — identifiers, contact details, financial information and internet activity — from you directly and from your browser, for the purposes in section 3, and disclosed them to the recipients in section 4. We do not knowingly sell or share the personal information of anyone under 16. Once your information reaches a lender, that lender is a separate business responsible for its own CCPA obligations, and a request to us does not reach it; contact the lender directly.

Shine the Light. California Civil Code § 1798.83 lets California residents ask once a year about personal information disclosed to third parties for their own direct marketing. Send that request to the same address.

10. Email choices

Optional marketing email is never a condition of funding. You can withdraw consent at any time using the unsubscribe link in any message or through our unsubscribe page. We honour one-click unsubscribe requests sent by your mail provider. Suppression is recorded so the address is not contacted again.

11. Cookies

We use only the cookies and local storage strictly necessary to serve and secure the site. We do not run advertising cookies on this site, and we do not operate cross-site tracking here. Most browsers let you refuse or delete cookies through their settings.

12. Changes to this Policy

We may update this Policy. Changes take effect when posted here, and the “last updated” date will reflect the latest revision. If a change materially affects how we use information you have already given us, we will take reasonable steps to tell you.
